. some of these weapons he used during friday morning's mass shooting that turned the premier into an historic massacre. holmes is currently in solitary confinement at a county detention facility where he is not cooperating. he has been assigned a public defender. he will be advised of his rights and the judge is expected to set a date for the formal filing of charges. he is expected to face at least 70 charges, one for every person he shot and he could face additional counts of aggravated assault and weapons violations. holmes' first court appearance part of what could take months. >> we will convict. yes. >> a big issue is whether the prosecutor will seek the death penalty. the defense will likely argue whether holmes is mentally competent. his legal team is expected to go inside the century 16 movie theater today to look at what's left to help put together a defense. holmes is expected in court at 8:30 this morning. >> so many watching that. grief, anguish, anger for friends and family of the 12 people killed at that theater. this morning we're getting a first look at some of those
